On June 26, 2025, the court reversed and rendered judgment in a case of first impression interpreting Texas Family Code section 8.056(b), which addresses termination of spousal maintenance due to post-divorce cohabitation. This marks the first time a Texas appellate court has defined the phrase “cohabitates on a continuing basis” since the statute was enacted in 1995.
The court’s published opinion provides much-needed clarity for family law courts and practitioners across the state. It establishes a clear, workable standard for determining when spousal maintenance may be terminated under this provision. The ruling is expected to be cited in future cases and become an important reference point in Texas family law.
